1. Overview
These Terms of Service ("Terms") govern your access to and use of websites, applications, software, services, beta programs, plugins, and tools provided by Appdemon (collectively, the "Services").
By accessing, downloading, installing, purchasing, or using any of our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our Services.
2. License
Our software and Services are licensed, not sold.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or internal business purposes.
Unless expressly permitted, you may not:
- Resell, sublicense, rent, lease, or distribute the Services
- Reverse engineer, decompile, disassemble, or attempt to extract source code
- Remove, alter, or circumvent licensing, security, or access controls
- Use the Services in a manner that violates applicable laws or regulations
3. Beta Services
Some Services may be offered as alpha, beta, preview, early access, or experimental releases.
Beta Services:
- May contain bugs, errors, or incomplete features
- May change substantially before release
- May be modified, suspended, or discontinued at any time
- May provide temporary access to premium features
We make no guarantees regarding the availability, stability, or future release of Beta Services.
4. Accounts, Licenses & Activation
Certain Services may require:
- A user account
- License key
- Subscription
- API key
- Activation token
Licenses may be subject to usage, seat, device, account, or subscription limitations.
You are responsible for maintaining the security of your account credentials, license keys, and API keys.
We reserve the right to suspend, restrict, or revoke access in cases of:
- Fraudulent activity
- Abuse of licensing systems
- Unauthorized sharing or resale
- Violation of these Terms
5. Payments & Refunds
Paid Services may be processed through third-party payment providers, including but not limited to Stripe, Paddle, Apple, Google, or other authorized providers.
We do not store full payment card details.
Unless otherwise required by law:
- Refund eligibility is determined according to the applicable product, subscription, platform, or payment provider policies.
- If a refund is granted, associated licenses, subscriptions, or access rights may be revoked.
6. Third-Party Services & Integrations
Our Services may integrate with or rely upon third-party products, APIs, platforms, or services.
Examples include:
- Google Workspace
- Slack
- Atlassian products
- OpenAI
- GitHub
- Apple services
- Microsoft services
When using third-party integrations:
- You are responsible for maintaining appropriate permissions and credentials.
- You must comply with applicable third-party terms and policies.
- Your use of those services is governed by their respective agreements.
We are not responsible for:
- Third-party outages or downtime
- API changes or discontinued services
- Data loss caused by third-party providers
- Loss of functionality resulting from third-party changes
All third-party trademarks, logos, and brand names remain the property of their respective owners. Reference to third-party products does not imply affiliation, sponsorship, or endorsement unless explicitly stated.
7. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Attempt to gain unauthorized access to systems, accounts, or data
- Disrupt, damage, or interfere with the operation of the Services
- Misuse integrations, APIs, or automation features
- Upload, distribute, or transmit malicious software or harmful content
- Circumvent usage limits, licensing restrictions, or security controls
8. Updates & Changes
We may:
- Update, modify, replace, or remove features
- Release new versions of the Services
- Change pricing, plans, licensing models, or availability
Some updates may be required to continue using certain Services.
9. Intellectual Property
All rights, title, and interest in the Services, including software, designs, trademarks, content, branding, documentation, and related materials, remain the property of Appdemon or its licensors.
These Terms do not grant ownership of any intellectual property rights.
10. Disclaimer
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Reliability, availability, or uninterrupted operation
We do not guarantee that the Services will be error-free, secure, or continuously available.
11. Limitation of Liability
To the maximum extent permitted by law, Appdemon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of data
- Service interruptions
Our total liability arising from or relating to the Services shall not exceed the amount paid by you to Appdemon during the twelve (12) months preceding the claim.
12. Termination
We may suspend or terminate access to any Service at our discretion if:
- You violate these Terms
- Continued access presents a security, legal, or operational risk
- Required by law or third-party obligations
You may stop using the Services at any time.
Upon termination, all licenses granted under these Terms automatically cease.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms periodically.
The latest version will be published on our website with an updated effective date.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
